Harvey Weinstein Convicted of Assaulting One of Four Accusers

A California jury has found Harvey Weinstein guilty on 3 of the 7 counts against him. All three counts pertained to a "Jane Doe #1", an Italian model who testified Mr. Weinstein attacked her in her hotel room at the "Mr. C Hotel" in February 2013. Here's a recap of Jane Doe #1's testimony and her daughter's testimony .

The jury acquitted Weinstein of sexual battery as to Jane Doe 3, a massage therapist, and hung on counts of sexual battery by restraint pertaining to Jane Doe 2, who has been publicly identified as Lauren Young, an actress and screenwriter.

The jury also hung on three counts, pertaining to Siebel Newsom (wife of CA. Gov. Gavin Newsom), who alleged Weinstein raped her at the Peninsula Hotel 18 years ago. During the trial she testified:

 “I could tell he just needed, he was so determined, just so scary, just all about him and his pleasure, his need for satisfaction, so I just did it to make it stop,” Siebel Newsom told the jury.

Harvey Weinstein Transferred, Contracts Coronavirus and Is Put in Isolation

Four days ago, on March 18, Harvey Weinstein was transferred to a reception facility at the Wende prison complex in Erie County, New York. Reception facilities are intake facilities where a new inmate undergoes diagnostic testing and observation and then the staff decides which prison he should be sent to to serve his sentence. Wende also has a maximum security prison.

Apparently, upon arrival he and another new transferee tested positive for the Coronavirus and were put in isolation in the medical unit at Wende's maximum security prison.

Wende has a long history as a prison, going back to the 1920's. It is now comprised of 49 buildings on 15 acres. It has a Regional Medical Unit (RMU) at the maximum security prison that at least on paper, provides comprehensive care. [More...]

Harvey Weinstein Acquitted on Most Serious Counts

Harvey Weinstein was found guilty of one count of a first degree criminal sex act against Miriam "Mimi" Haley and one count of third degree rape as to Jessica Mann. He was found not guilty of the more serious predator sexual assault charges for which he could have received a life sentence. The reason for the acquittal on the top two charges: The jury did not believe Annabelle Sciorra's 30 year old account of what Weinstein did to her.

The first degree criminal sexual act charge carries a penalty of 5 to 25 years in prison. The third degree rape charge is punishable by anywhere from probation to up to 4 years.

In order to convict him on the more serious sexual predator charges, the jury would have had to have believed Annabelle Sciorra that he raped her 30 years ago and with respect to Jessica Mann, that he had committed the more serious first degree rape charge against her. That they acquitted him on all three of those charges is a testament to the work by his defense team.
